Affiliate Terms
These terms govern the Presstack affiliate programme. By joining, you agree to them. They're written to be read rather than to be impenetrable. If anything here is unclear, ask before you sign up rather than after.
Who This Agreement Is Between
This agreement is between you, the affiliate, and Pressstack AI. We refer to ourselves as "we", "us" and "Presstack".
You may be an individual or a business, and you may be anywhere in the world, subject to section 13.
This is not an employment contract, a partnership, or a franchise. You are an independent party promoting a product. Nothing here makes you our agent, and you have no authority to make commitments on our behalf.
Joining The Programme
You join by creating an affiliate account. There is no application process and no approval step.
By joining, you confirm that:
- 1) You are at least 18 years old, or the age of majority where you live, whichever is higher.
- 2) The information you give us is accurate, and you will keep it up to date.
- 3) You are legally permitted to enter this agreement and to receive payments from us.
- 4) You are not a person or entity we are prohibited from dealing with under sanctions or export control laws.
We may decline or close an affiliate account at any time. See section 14.
What You Earn
The rate is 10%. It applies to every payment a customer you referred makes to us, including:
- 1) Subscription payments, every month or year, for as long as the subscription continues
- 2) Credit purchases
- 3) The Presstack Pro pack and the Presstack EC Pro pack
- 4) Any additional site a referred customer adds to their account
There is no cap, no tier system, and no minimum you must reach before the rate applies.
Commission is calculated on the amount actually paid to us, excluding any tax charged on the sale — VAT, sales tax, GST or equivalent. If a customer pays with a discount applied, commission is calculated on what they actually paid.
Commission continues for the life of the account. It does not stop after twelve months, or after any other period. It stops when the customer stops paying.
How A Referral Is Tracked
When someone clicks your affiliate link, a cookie is stored in their browser recording that you referred them. That cookie lasts twelve months.
If they create an account and buy something within those twelve months, the purchase is attributed to you.
Some things worth knowing about how that works in practice:
- 1) Tracking depends on the cookie surviving. If someone clears their browser data, uses a different device, or uses a browser that blocks the cookie, the referral may not be recorded. We can't attribute a purchase we have no record of.
- 2) The last affiliate link clicked wins. If a customer clicks your link and then somebody else's before buying, the commission goes to the other affiliate.
- 3) An existing customer is not a new referral. If somebody already has a Presstack account, clicking your link does not transfer them to you.
Our records of referrals are the ones we act on. If you believe a referral has been missed, tell us and we'll look into it, but we can only work from the data we have.
When Commission Becomes Payable
A commission is recorded when a referred customer makes a payment.
It becomes payable 72 hours after that payment. That delay exists so that trials, cancellations and failed payments settle before money moves.
Commission is not earned on:
- 1) Trial signups where no purchase follows
- 2) Accounts created but never paid for
- 3) Any payment that is later refunded, reversed or charged back
Refunds, Charegbacks & Cancellations
If a customer receives a refund, or their payment is reversed or charged back, the commission on that payment is cancelled.
If we have already paid you that commission, the amount is deducted from your next payout. If your balance is not enough to cover it, we may ask you to repay the difference, and we may hold future commissions against it.
This applies however long after the payment the reversal happens.
If a referred customer cancels their subscription, commission simply stops with their payments. Nothing already paid to you is clawed back.
Getting Paid
You can request a payout whenever you like. There is no monthly cycle.
- 1) Minimum request: £20.
- 2) Paid by PayPal. You need a PayPal account that can receive payments in your country.
- 3) Payouts are made to the PayPal address on your affiliate account. Keep it current. We are not responsible for money sent to a wrong address you gave us.
We aim to process requests within 3 working days.
Everything is in pounds sterling. Commission is calculated, recorded and paid in GBP. Your affiliate dashboard shows GBP, and we send GBP.
If your PayPal account is held in another currency, PayPal converts the payment when it arrives, at PayPal's exchange rate, and applies whatever fee they charge for that. We have no control over either and no part in setting them. The amount you receive in your own currency will therefore be somewhat less than the sterling figure shown in your dashboard, and it will move with the exchange rate.
If that matters to you, a PayPal account that can hold GBP avoids the conversion entirely.
Tax is your responsibility. Commission is paid gross. You are responsible for declaring it and for paying any income tax, VAT, sales tax, or other tax due where you live. If you are registered for VAT or an equivalent and need to invoice us, tell us and we'll arrange it.
If we are legally required to withhold tax from a payment to you, we will, and we'll tell you.
Unclaimed balances. If your account is inactive for 12 months and your balance is below the minimum payout, we may close the account and the balance is forfeited.
How You May Promote Presstack
You are free to promote Presstack in most of the ways you'd expect: your own website, a blog post, a review, a video, a newsletter, a course, social media, a recommendation to a client, or paid advertising.
Paid search advertising is allowed, including on our brand name. You may bid on "Presstack" and related terms. Most programmes forbid this. We don't.
That permission has limits, and they matter:
- 1) You may not use presstack.ai, or anything resembling it, as the display URL in an advertisement. The URL shown must be yours.
- 2) Your advertisements must not imply they are ours. No "official site", no "Presstack - Official", nothing anyon would read as an advertisement placed by us.
- 3) You may not bid in a way that impersonates us, including using our logo in a way that suggests the ad is official.
- 4) We may withdraw this permission generally, or for an individual affiliate, on notice. If we do, you must stop within a reasonable period.
You may use our name, logo and screenshots for the purpose of promoting Presstack. That permission is limited to this purpose, lasts only as long as this agreement, and does not transfer any ownership. Don't modify the logo.
What You May Not Do
No self referrals. You may not use your own link to buy a licence for yourself, or for a business you own or control, or arrange for someone else to do so on your behalf. Commission on a self referral is void.
If a client of yours pays for their own licence and you referred them, that is a genuine referral and it counts, even if you manage the site.
No coupon, deal or voucher sites. We do not accept referrals from sites whose purpose is to distribute discount codes or capture people at the point of purchase.
No unsolicited email or messaging. Do not send bulk email, direct messages or texts to people who have not asked to hear from you. If you email your own list, comply with the law where your recipients are - that includes UK GDPR and PECR, the GDPR in the EU, CAN-SPAM in the US, and CASL in Canada.
No cookie stuffing or forced clicks. Do not set the affiliate cookie without a genuine, deliberate click. That includes pop unders, iframes, automatic redirects and extensions.
No misleading claims. Do not say anything about Presstack that isn't true. Specifically:
- 1) Do not promise anybody rankings, traffic, revenue or sales. Nobody can deliver those, and a claim like that creates a liability for us as well as for you.
- 2) Do not invent features, integrations or figures.
- 3) Do not present a price we haven't published, or a discount that doesn't exist.
- 4) Do not claim to be us, to be endorsed by us, or to speak for us.
No trademark or domain registrations. Do not register domain names, social accounts, app names or business names containing "Presstack" or anything similar.
Nothing unlawful or damaging. Do not promote Presstack on sites containing illegal material, hate speech, adult content, or anything that could damage our reputation.
Telling People You Are An Affiliate
You must disclose the relationship, clearly, wherever you promote Presstack.
This is a legal requirement in most places, not a preference of ours. In the UK it falls under the CAP Code and the Digital Markets, Competition and Consumers Act. In the United States it's the FTC Endorsement Guides. The EU, Canada, Australia and many other countries have equivalent rules.
What that means in practice:
- 1) The disclosure must be easy to notice and easy to understand. Plain words like "affiliate link" or "I earn a commission if you buy through this link".
- 2) It must be close to the link, not in a footer, not buried in a page nobody opens, not hidden behind "more".
- 3) On video or audio, say it as well as writing it.
- 4) It must be there whether or not you're also giving an honest opinion.
We may ask you to add or improve a disclosure. If you don't, we may close your account.
Liability for an undisclosed advertisement can fall on the advertiser as well as on the affiliate, which is why we care about this more than you might expect.
Our Obligations, And Their Limits
We will:
- 1) Track referrals accurately as far as we reasonably can
- 2) Show your referrals, commissions and balance in your affiliate dashboard
- 3) Pay valid commission requests
We do not promise:
- 1) That the tracking will capture every referral. Browsers, privacy settings and user behaviour are outside our control.
- 2) That the programme, the commission rate, or these terms will stay the same. See section 15.
- 3) Any particular level of earnings. Nothing on our website or in our materials is a forecast of what you will make.
- 4) That the affiliate dashboard will be available without interruption.
Data Protection
If you give us personal data inclujding your own or anybody else's, each of us is a separate data controller for our own purposes.
We process your data to run the programme and to pay you. Our privacy policy explains how.
If you collect personal data in the course of promoting Presstack such as email addresses for a list for instance, that's yours to handle lawfully. We have no involvement in it and no responsibility for it.
You must not pass us personal data about anybody else except where it's necessary to resolve a specific referral query.
Where You Can Be
You may join from most countries. You may not join, and we may not pay you, if you are located in, or are a national or resident of, a country subject to sanctions or trade restrictions that would make the payment unlawful under UK, EU or US law, whichever applies.
If sanctions change and affect your account, we will tell you and stop payments. Commission already earned and lawfully payable will be paid.
You are responsible for checking that participating is lawful where you are.
Ending The Arrangement
You may leave at any time, by closing your affiliate account or by telling us. Commission on customers you have already referred continues to be paid for as long as those customers keep paying, and you may still request payouts.
We may close your account at any time, on notice, for any reason or none. If we do this without you having breached these terms, commission already earned is paid, and commission on existing referrals continues for 12 months.
We may close your account immediately, without notice, if you breach these terms. In that case, unpaid commission is forfeited and future commission stops.
If we end the programme entirely, we will give at least 90 days notice. Commission earned up to the closing date is paid.
Changes To These Terms
We may change these terms, including the commission rate and the cookie window.
We will give at least 30 days' notice of any change that reduces what you earn or materially restricts what you may do, by email to the address on your affiliate account.
Changes apply from the date they take effect. They do not reduce commission already earned before then.
If you don't accept a change, close your account before it takes effect.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that:
- 1) Neither of us is liable to the other for lost profits, lost revenue, lost opportunity or indirect losses.
- 2) Our total liability to you, for everything arising out of this agreement, is limited to the total commission we have paid you in the twelve months before the claim, or £100, whichever is higher.
You are responsible for what you publish. If a claim is made against us because of something you said, did, or failed to disclose while promoting Presstack, you agree to cover our reasonable costs in dealing with it.
General
The whole agreement. These terms, together with our terms of service and privacy policy, are the whole agreement between us about the affiliate programme.
If part of it fails. If any part of these terms turns out to be unenforceable, the rest still applies.
Not waiving anything. If we don't enforce something immediately, that doesn't mean we've given it up.
You can't transfer it. You may not assign this agreement to somebody else without our written consent. We may assign ours if the business is sold or reorganised.
No third party rights. Nobody other than you and us has rights under this agreement.
The Law And Where Disputes Are Settled
These terms are governed by the law of England and Wales.
Any dispute will be dealt with by the courts of England and Wales, and both of us agree to that.
If you are a consumer rather than a business, you may also have the right to bring proceedings in your own country, and the mandatory consumer protection law of your country may still apply to you. Nothing here removes rights you have that cannot be removed by agreement.
